Is it legal for a minor to posses alcohol in Texas?
Yes, minors are allowed to possess alcohol in Texas, with stipulations.
Under Texas Alcoholic Beverage Code section 106.05, a minor may possess alcohol:
- At their job: While in the course and scope of the minor’s employment if the minor is an employee of a licensee or permittee and the employment is not prohibited.
- Parental supervision: If the minor is in the visible presence of his adult parent, guardian, or spouse, or other adult to whom the minor has been committed by a court.
- Police presence: If the minor is under the immediate supervision of a commissioned peace officer engaged in enforcing the provisions of this code.
- Educational purposes: If the beverage is lawfully provided to the minor under section 106.16 (course of study).
Is it legal for a minor to drink alcohol in Texas?
Yes, but only in one instance.
Under Texas Alcoholic Beverage Code section 106.04 (alcoholic consumption by a minor), it is an “affirmative defense” to the prosecution that the alcoholic beverage was consumed in the visible presence of the minor’s adult parent, guardian or spouse.
Essentially, this means that as long as a minor consumes alcohol in the visible presence of their parent, guardian or spouse, it is legal to do so.
Is it legal for a minor to drink alcohol at home in Texas?
It depends.
Yes, if the minor’s parents are there and in visible presence of them while drinking.
However, say the minor is having a house party with no parental supervision. Then it would be illegal for them to drink alcohol.
The penalty for underage drinking is a Class C misdemeanor, which is punishable by a fine up to $500. The minor may also be subject to:
- Attending an alcohol awareness class.
- 8-12 hours of community service on the first offense, 20-40 hours on second offense.
- A 30-day driver license suspension on the first offense, 60-day suspension for the second offense, 180 days for the third.
