Caught on the Kiss Cam? What are your privacy rights at DFW sports stadiums?
A couple attending a Coldplay concert got caught on the Kiss Cam in a close embrace, only to duck out of frame in what has become a viral moment, compounded by the revelation that one of the pair, CEO Andy Byron, was married to another woman.
Byron is the CEO of Astronomer, a company that operates a data orchestration and observability platform, which includes working with the Texas Rangers on real-time analytics. The partnership was announced in 2024.
What privacy rights would Bryan have had at Globe Life Field or other Dallas-Fort Worth stadiums?
According to terms and conditions of entering games for the WNBA’s Dallas Wings, the NHL’s Dallas Stars, the NFL’s Dallas Cowboys, the NBA’s Dallas Mavericks and the MLB’s Texas Rangers, fans entering stadiums give up their rights to privacy while in and outside of the stadium.
While exact wording varies from team to team, the Rangers’ policy says: “We have the unrestricted right and license to use Holder’s name, image, and/or likeness taken at or around Globe Life Field or Choctaw Stadium, as applicable, and their surrounding areas including parking areas (collectively and as applicable, the “Venue”) as included in any broadcast, telecast, photograph, or in any other medium whether now known or hereafter devised.”
Byron has yet to release a public statement on the incident. A fake public statement purported to be by Byron spread quickly on social media but was revealed to be false by a New York Post article.
