THC products are disappearing from Texas smoke shops. Here’s what you can still buy

If you usually buy THC products at a smoke shop in Texas, things are about to look different soon.

Starting Tuesday, March 31, a new state rule will limit what stores can legally sell, meaning some products will disappear from shelves.

But not everything is going away, and not everything is illegal.

Here’s what to know.

Which THC products will no longer be sold in Texas?

Texas retailers will no longer be allowed to sell most smokable hemp products.

That includes THCA flower, also known as raw hemp flower buds, along with pre-rolled joints and other products designed to be smoked.

Concentrates and extracts like dabs, live resin and drippers are also affected under the new rule.

The change is tied to a new “total THC” testing standard adopted by the Texas Department of State Health Services.

Instead of only measuring delta-9 THC, the updated rule also includes THCA, which converts into THC when heated. Because of that, many products that were previously considered legal now exceed the state’s legal limit.

While stores won’t be allowed to sell them, that doesn’t mean they suddenly become illegal to have.

“This is simply a regulatory change impacting what businesses can sell. It does not affect the legality of possession in Texas,” Director of the Texas Cannabis Policy Center Heather Fazio said.

You can also still get smokeable hemp products from outside the state, including through online retailers or by purchasing them while traveling.

“Only Texas companies are subject to the new rule, so consumers in Texas can still have it shipped directly to their door,” Fazio said.

What THC products can I still buy in Texas?

Not all THC-related products are affected by the new rule.

Products like edibles, including gummies and chocolates, can still be sold as long as they meet the state’s THC limits.

Hemp-infused beverages, such as seltzers and teas, are also expected to remain available, along with tinctures and low-THC oils.

Topical products like creams, lotions and balms can still be sold as well, along with non-intoxicating CBD products that fall within the legal threshold.
