Man fires 33 shots at cops, hits neighbor’s home where kids slept, CO officials say
A Colorado man accused of firing more than 30 times at police – and hitting his neighbor’s house – is heading to prison for decades, prosecutors said.
A judge sentenced Levi Miller to 156 years behind bars, saying “it’s astounding to me that you did not kill someone that day,” according to an April 14 news release from the Weld County District Attorney’s Office.
The sentence came after a jury convicted Miller, 34, of multiple charges, including two counts of attempted first-degree murder – after deliberation, and four counts of attempted first-degree murder – extreme indifference, plus two counts of first-degree assault, prosecutors said.
McClatchy News reached out to Miller’s attorney April 14 and was awaiting a response.
In court, Miller’s attorney said her client thought the officers were intruders, the Greeley Tribune reported. She also said he sustained a traumatic brain injury a couple years earlier in a wreck, according to the outlet.
Police were called to Miller’s home in Eaton in September 2021 “to a report of a domestic dispute,” prosecutors said.
Officers found Miller “armed with a MK47 rifle with a fully loaded 100 round drum” when they arrived, according to prosecutors.
Miller fired 33 times at police, prosecutors said.
While he was firing, he hit the home of a neighbor, piercing a gas line and hitting a bedroom wall, prosecutors said.
Two children were asleep in the bedroom, according to prosecutors.
“I don’t care if you call it luck, a blessing or a miracle. The fact that any of these people can walk into the courtroom today is simply amazing,” Chief Deputy District Attorney Michael Pirraglia said in the news release.
Police fired back at Miller, hitting him, according to prosecutors. The district attorney, following an investigation, determined they were justified in firing, prosecutors said.
Weld County Judge Audrey Galloway handed down Miller’s sentence.
Eaton is about a 70-mile drive north from Denver.
