Parker County parents file lawsuit over April school bus accident that killed daughter

The parents of a 6-year-old girl who was killed in April when she was hit and run over by a school bus in Parker County filed a lawsuit on Tuesday against the Brock school district and two companies.

Sean and Tori Sayre of Weatherford filed the lawsuit in Dallas County against the Brock school district, Blue Bird Body Company and Rush Truck Centers of Texas in the death of their daughter, Emory Sayre.

Officials with the Brock school district, Blue Bird and Rush Truck Centers could not immediately be reached on Tuesday for comment.

Emory Sayre, a Brock Elementary student, was killed on April 25 when she was dropped off by a Brock ISD school bus and then hit by the bus as she walked in front of it.

The Sayres are seeking in excess of $1 million.

The girl, who was in kindergarten at Brock Elementary School, had just been dropped off near her Parker County home in the 400 block of Canyon Creek Circle by the school bus.

She was the last of three students to walk in front of the bus, according to the lawsuit.

Emory fell under the right side of the bus and was then run over by the front right and rear right tires, the lawsuit states. She was taken to Medical City Weatherford hospital, where she died from her injuries an hour after the accident.

The bus driver was not criminally charged in the case.

Blue Bird designed and manufactured the bus, and the Brock school district bought it in 2019 from Rush Truck Centers in Dallas County, according to the lawsuit.

The suit alleges that Brock school officials failed to provide a safe environment for Emory Sayre.

The lawsuit also alleges design defects against the manufacturer of the bus for not installing student detection systems and school bus motion sensor technology.

Such life-saving technologies designed to prevent tragedies have been available for years, according to the lawsuit.
