Texas Live! asks Noteboom law firm to remove billboard advertising $63M verdict

A Fort Worth lawyer says he’s been asked to remove a billboard that advertises a $63 million verdict his firm won against Texas Live!

The billboard, on eastbound Interstate 30 in Fort Worth near Beach Street, advertises the Noteboom law firm and references a multimillion-dollar judgment against the entertainment complex in a lawsuit over a man who was beaten by a bar bouncer, an image of the billboard shows.

Lawyers for Live! Holdings LLC, the company that manages Arlington’s Texas Live! property, argue the Noteboom firm is infringing on the company’s trademark, according to emails shared with the Star-Telegram.

The verdict mentioned in the advertisement was awarded in November by a Tarrant County jury who found that a man suffered severe brain injuries when a security guard at a Texas Live! bar smashed a glass over his head in 2018, the Star-Telegram previously reported.

Attorney Chuck Noteboom said his firm plans to patch over the word Live! on the billboard to change its appearance, and to double the number of billboards from three to six.

Noteboom said the company has threatened to pursue legal costs against the disabled veteran who was the plaintiff in the lawsuit. “They will ignore the verdict and tie it up on appeal on garbage grounds. And offer $0 and send offensive threats after our client,” he said.

After jurors returned their verdict in the lawsuit, a Texas Live! representative said in a statement, “Texas Live! is committed to providing a safe environment for its millions of visitors each year. The isolated incident occurred in 2018 between an individual and a representative of a third-party security company and is in the process of being appealed.”

Lawyers for Live! Holdings said in a letter to the Noteboom firm that the advertised verdict is “false, or at the very least misleading,” according to the emails.

“Our client has not approved this use of its registered Live! Logo and TEXAS LIVE! Mark,” the email reads. “We have contacted the Noteboom law firm and explained that their use of our client’s trademarks (is) infringing, and they do not have a valid fair use defense.”
