All eyes are on Ezekiel Elliott and what happens with his six-game suspension for violating the NFL’s personal conduct policy this week.

Former Cowboys great and NFL Network analyst Michael Irvin, though, remains under review by the league for violating the personal conduct policy stemming from an incident last March, NFL spokesman Brian McCarthy said on Tuesday.

Irvin, 51, had legal charges dropped in July by the Broward County (Fla.) State Attorney’s Office, as those city’s prosecutors cited “a lack of evidence.”

But, as it’s been shown with Elliott, the NFL can issue discipline without legal charges. And the personal conduct policy is enforced for everyone associated with the NFL, not just players.

The policy reads:

Everyone who is part of the league must refrain from “conduct detrimental to the integrity of and public confidence in” the NFL. This includes owners, coaches, players, other team employees, game officials, and employees of the league office, NFL Films, NFL Network, or any other NFL business.

Irvin continues to serve as an analyst for NFL Network, posting a picture on his Twitter account of him from set on Tuesday night as he went on air.

The alleged incident happened in the early hours of March 21 when a 27-year-old woman told police she feared she was drugged and raped by Irvin. The rape kit in the investigation came back negative, Irvin told TMZ in May.

Irvin has been through this sort of situation before, and has never been criminally charged.

In 2007, he was accused of sexually assaulting a woman in a hotel room. Prosecutors didn’t press charges and each side sued another in civil court in a case that resulted in a confidential settlement.
