Can you use the HOV lane if you’re the only one in the car? What Texas law says

It’s brutal being stuck in rush hour traffic while the carpool lane zips by you, sitting lonesome and bored in your car. The temptation to hop over just for a minute to just get past the bumper-to-bumper is attractive, but could cost you a pricey ticket.

High occupancy vehicle lanes (HOV lanes) are reserved for vehicles occupied by two or more passengers.

According to TxDOT, HOV lanes can improve traffic and commute times, reduce congestion and decrease fuel costs and fuel emissions by encouraging carpooling.

In North Texas, there are two carpool lanes located along Interstate 30 through Dallas and the U.S. Highway 75 through Richardson and Plano.

Here’s what the Texas law says about using HOV lanes– who can drive in them, who shouldn’t drive in them and consequences for violating the law.

Who is allowed to drive in HOV lanes?

According to the Texas transportation code, these vehicles are permitted in HOV lanes if they have two or more passengers in the car:

  • Cars
  • Pickup trucks 
  • Vans 
  • Buses 
  • Motorcycles (does not need an extra passenger to utilize HOV lanes) 
  • Emergency vehicles responding to a call

The following vehicles are never allowed in an HOV lane:

  • Hybrid vehicles with single occupants
  • Trucks with more than two axels
  • Trucks with weight capacity of five tons or more
  • Vehicles towing trailers 

Can a single passenger vehicle enter the HOV lane when no one is around?

Though being sneaky can sometimes work, it is still against the law to use an HOV lane as a single passenger vehicle during any circumstance.

You can try, but it may result in a fine.

What are the consequences for misusing the HOV lane?

If one is caught using a carpool lane when they are not carpooling, they will be pulled over.

In Texas, drivers who incorrectly enter, exit or misuse an HOV lane could be fined no more than $100. If you fail to pay on time, that’s a Class C misdemeanor.
