A Texas man is suing after he says he was given the wrong meal at Whataburger, leading to an allergic reaction.

Demery Ardell Wilson filed the lawsuit in Harris County Court on April 25 against Whataburger.

Wilson said he visited a Whataburger location on July 24, 2024 and ordered a meal with no onions, the civil complaint said.

However, he was given onions on his food, which led to an allergic reaction causing him to seek medical care, the lawsuit said.

The complaint said the fast-food chain was negligent and should have known “the danger of (its) actions.”

However, in a response filed May 16, Whataburger denied it was negligent, caused any damages or should have known its products could cause Wilson any injuries, according to the court document.

Wilson is suing for “physical pain and mental anguish” and costs for medical treatment, the complaint said.

The lawsuit is asking for between $250,000 and $1 million in damages, court records said.

On May 22, 2024, Wilson filed a similar lawsuit against Sonic Drive-In, accusing it of giving him onions on a meal after he requested no onions. Like in this lawsuit, Wilson said he had an allergic reaction to the onions leading to him needing medical care.

On May 12, Sonic filed a response denying all allegations.
