Florida High School Band Director Allegedly Sent Sexual Messages to Student

A high school band director in Florida has been arrested after he allegedly sent sexual social media messages to a student.

The Fort Myers Police Department announced in a news release that Leroy Irving Jr. was arrested by the U.S. Marshals Service on Tuesday, May 12.

Irving worked as the band director at Dunbar High School in Lee County at the time of his arrest.

The police department said in the news release that it had been investigating Irving ever since they received a complaint about him and a student in March. However, they did not share any details about what the complaint entailed or who submitted it.

"After several months of investigation, detectives learned that Irving had been communicating with the student through several social media applications and that the conversations were sexual in nature," police said in the statement.

After his arrest, Irving was charged with an authority figure engaging in a romantic relationship with a student, possession of child pornography and tampering with evidence in a criminal proceeding.

It is not currently clear if Irving has entered a plea or retained legal counsel following his arrest. The Fort Myers Police Department did not have any additional information to share about the case when contacted by Us Weekly on Wednesday, May 13.

The School District of Lee County reportedly suspended Irving from his position in March amid the investigation and he was barred from campus, according to Gulf Coast News.

Additionally, the district reportedly said it was initiating disciplinary proceedings following Irving's arrest.

More details are expected to be revealed as the investigation into the allegations against Irving continue.

If Irving is found guilty of the charges, he will likely spend a significant amount of time in prison.

In the state of Florida, those found guilty of the authority figure engaging in a romantic relationship with a student charge can be sentenced to serve up to 15 years in prison and can be ordered to pay a fine of up to $10,000, according to the Florida State statutes.

Meanwhile, a possession of child pornography offense is punishable with up to five years in prison and a $5,000 fine, according to Hanlon Law.

Those found guilty of tampering with evidence in a criminal proceeding can be sentenced to serve up to five years in prison, be given five years probation or be ordered to pay a $5,000 fee, according to Hussein & Webber's law firm.
