Man put gun down and hands up, then was shot at 38 times by Ohio cops, suit says
The family of an Ohio man is suing after they say police killed him as he complied with officers.
The federal lawsuit was filed July 7 against the city of Columbus, the director of public safety and several individuals with the Columbus Police Department.
McClatchy News reached out to the city of Columbus for comment July 8 but did not immediately hear back.
The lawsuit stems from a fatal shooting that occurred on July 8, 2023, in Columbus.
Just before 8 p.m. that day, a man approached a Franklin County sheriff’s deputy working at a Walgreens and reported a man was at a nearby apartment building with a gun, according to a June 25, 2024, news release from the Franklin County Prosecutor’s Office and police body camera footage. The deputy, along with Columbus police officers, arrived at the apartment and reported shots were fired, the body camera footage showed.
Inside the apartment building, they found a man, later identified as Antwan Lindsey, standing in a doorway between a hallway and a stairwell, the footage showed.
Officers surrounded Lindsey, with some cops on the stairwell and others in a hallway on the other side of the door, according to a civil complaint.
The officers on both sides repeatedly yelled at Lindsey to put his hands up and not to move. Lindsey had put his gun on the ground, had his arms raised “chin high” and stood motionless at the door, according to the lawsuit.
Then an officer on the stairwell yelled “taser, taser, taser” and tased Lindsey, the lawsuit said. The taser made a loud “popping noise” and struck Lindsey, causing his body to tense and fall, according to the complaint.
As the taser was deployed and Lindsey’s body began to fall, four officers on the other side of the door, in the hallway, opened fire on him, firing 38 shots, the lawsuit said.
The complaint said Lindsey had “surrendered and was incapacitated” when the officers shot him.
Lindsey was shot 15 times in the head, upper chest, arm, thigh and back, an autopsy revealed, according to WSYX.
A gun was found at the scene and matched shell casings from bullets fired at officers, prosecutors said.
The complaint said officers used excessive force and Lindsey “posed no immediate risk of harm” when he was shot.
Last year, a grand jury declined to indict the officers involved in the shooting, prosecutors said.
The lawsuit is asking for no less than $75,000 in damages.
