Charge dismissed against ex-ROTC instructor in Fort Worth

An improper-relationship charge has been dismissed against a former ROTC instructor at Diamond Hill-Jarvis High School who had been accused of having sex with a 17-year-old student starting in 2012.

The charge was dropped Thursday against Andres Javier Vianes, 52, who now lives in San Antonio, according to Tarrant County criminal court records.

“After investigating the offense and talking to witnesses, it was determined that this case was unprovable,” Tarrant County Assistant District Attorney Eric Nickols said.

The decision was made after officials consulted with the teen’s family, Nickols said.

Y. Leticia Sanchez Vigil of Fort Worth, Vianes’ attorney, did not return telephone calls.

Vianes and the high school student left Fort Worth and are now living in San Antonio, according to authorities.

Vianes, who was married while at the Fort Worth high school, was also having a second affair with a former student, investigators reported. He resigned from the school in January 2014.

Court records indicate that he was divorced in December after 28 years of marriage.

He had been indicted in June on a charge of improper relationship with a student and had faced a maximum sentence of two years in prison.

Vianes and the 17-year-old apparently began a relationship in 2012 when she was one of his ROTC students, according to an arrest warrant affidavit.

According to the affidavit, in January 2014, Vianes’ wife found a receipt in her husband’s pocket from a hotel at Naval Air Station Joint Reserve Base Fort Worth. She confronted him, but he made up a story and told her that he had to go to work. Later, she drove to the school, but he wasn’t there. She drove to the base hotel and found Vianes with the student.

A few days later, the student’s parents reported her missing.
