Carrollton business failed to pay overtime. Its employees received $141k in back wages

The U.S. Department of Labor recovered about $141,000 in back wages to North Texas employees who were not properly compensated for overtime at a home health care business, according to a news release.

The Labor Department’s investigation found Solid Care Home Health, in Carrollton, paid 28 non-exempt employees straight time for work over 40 hours and not the time and a half rate required by the Fair Labor Standards Act, the release says.

The business also failed to maintain proper timekeeping and personnel records, the department determined.

Back wages and liquidated damages each totaling $70,631 were recovered, according to the release.

“Home healthcare employees are among the nation’s hardest-working, lowest-paid workers and their employers must pay them all of their earned wages,” said Jesus A. Valdez, Dallas director for the Wage and Hour Division.

The announcement comes after the Department of Labor also found a Southlake based-business, J.P. Above & Beyond Landscaping, failed to pay its employees overtime, according to a news release. The company misclassified the affected employees as independent contractors, failing to pay its workers the time and a half rate for overtime worked, the department found.

Those employees were recovered $103,655 in back wages.

A spokesperson with Solid Care Home Health did not immediately respond to a request for comment.

Employees can learn more about the department’s Wage and Hour Division, file a complaint, and determine if they are owed back wages.
