Tarrant judge orders $5M in sanctions against Texas Live, its security firm

A Tarrant County judge ordered $5 million in sanctions against Texas Live! and its third-party security firm after a post-trial hearing Wednesday, according to court records.

The order stems from a November trial where a jury awarded over $60 million to a man who was injured in 2018 when a security guard at the entertainment complex smashed a glass over his head, the Star-Telegram previously reported. The man, a 54-year-old veteran and former police officer, had been out at Texas Live! as part of treatment for PTSD suggested by his counselor.

During the discovery phase of the November trial, lawyers for the injured man asked Texas Live’s security firm, Inner-Parish, to disclose all of the insurance policies it held, according to court documents.

Inner-Parish only disclosed one policy worth $1 million, when it actually held an additional policy worth $5 million, according to evidence presented at Wednesday’s hearing.

The security firm’s failure to produce that policy amounted to an abuse of the discovery process, which is where parties in the case must exchange information and evidence, lawyers for the man argued in court. In response, lawyers for Inner-Parish argued that while the firm did not produce the policies during the discovery phase, it did produce them prior to the jury awarding the final verdict.

When asked by the judge near the start of Wednesday’s hours-long hearing, attorneys for the parties could not reach an agreement on an appropriate value for the sanctions. Attorney Chuck Noteboom, whose law firm represents the injured man, argued that the hearing itself was costing his firm upward of $1 million in lost working hours in the time it was taking to settle the matter.

A human resources representative for Inner-Parish testified at the hearing that the company did not intentionally withhold the policies during the discovery phase of the trial.

Attorneys for Texas Live and Inner-Parish plan to appeal the $5 million sanctions, they said in the hearing Wednesday. The companies’ legal team has also appealed the $60 million initial judgment, according to court records.

Lawyers for either party could not immediately be reached for additional comment.
