Family sues after man was killed when he was pinned between buses

The family of a man crushed to death between two charter buses last month is suing the Arlington bus company for gross negligence and failing to properly train its employees.

The family of Philemon McLean, 64, filed the lawsuit on Tuesday in Tarrant County court against Dan Dipert Travel Services. McLean had worked for the company since 2013.

Philemon McLean was killed at about 5:30 a.m. on April 22 at Dan Dipert Travel Services’ facility in the 7300 block of West Pioneer Parkway in far west Arlington.

McLean, who cleaned buses, had parked a bus and was standing outside of it with another employee when he noticed that it had started to roll, police said. He then tried to “make a run for the [bus] door” but was crushed between the front of the bus and another parked bus, police said.

Police said they weren’t sure what caused the bus to start rolling.

In the lawsuit, the McLean family’s attorney says the charter bus company had failed to maintain control of the vehicle or adequately train the employees cleaning them, including not implementing safety protocols or using safer alternative methods.

McLean was the first Dipert employee to die on the job since the company opened in 1972, the company said at the time.

The Dallas attorney representing the McLean family did not return a phone call from the Star-Telegram seeking comment.

A representative of Dipert was not immediately availble for comment Wednesday.
