Who regulates home warranty companies in Florida?

Florida is among the states that have created regulations governing home warranty companies. A home warranty can only be written by a business with a license granted under Florida Statutes Section 624.303 or by an insurance company authorized by the state to write these contracts.

The warranty company must provide a complete sample of the terms and conditions if you request it. If you don’t request one, they are not required to provide the document. Also, the company may not need to provide you with a copy if they have a full sample on a website.

Home warranty companies are required to provide you with a list of all exclusions, restrictions or limitations. There must also be a written disclosure stating that “the rate charged for the contract is not subject to regulation by the Office of Insurance Regulation.”

Home warranty contracts can’t exclude coverage if there is rust or corrosion present unless the rust or corrosion caused the problem with an appliance or system. For air conditioners, if a contract excludes normal wear and tear on specific components of the system, it must offer an add-on or equivalent optional coverage to cover the components.

If your home warranty contract has no cancellation provision, it violates state law. You’re allowed a 10-day window where you are eligible for reimbursement of 100% of your total premiums, less any claims or a maximum administrative fee of 5%. Additionally, the company cannot raise your premiums — or impose a fee upon you — above the current cost of a new contract upon renewal unless a claims history warrants a raise.
