One of the motorists involved in a collision in Arlington last month in which a baby in a stroller was killed will be issued a citation for failure to yield right of way, Arlington police said Monday.
No criminal charges will be brought in the death of 7-month-old David Bingenheimer on May 29, police said.
The decision to issue the citation came after a police investigation and in consultation with the Tarrant County district attorney’s office, Arlington police Sgt. Jeffrey Houston said in an email.
The citation will be issued to Shantell Skillern, 46, who was northbound on South Cooper Street and was trying to make a turn when her Chrysler and a southbound Toyota pickup collided.
The pickup veered to a sidewalk where it hit the baby in a stroller being pushed by his father, Daniel Bingenheimer.
The baby was pronounced dead at the scene, according to the Tarrant County medical examiner’s office.
Skillern and Daniel Bingenheimer were treated for minor injuries at Medical Center of Arlington and were released.
Phat Cao, 42, the pickup driver, apparently was not injured.
