Johnson County teen shot, killed on her birthday

A 13-year-old girl died Tuesday night at a Fort Worth hospital after she was shot by her stepbrother, who had been clearing the chamber of a rifle, authorities said Wednesday.

Investigators called the incident an accidental shooting and no charges are expected to be filed.

The Tarrant County medical examiner’s office on Wednesday identified the victim as Emilee Bates. She died shortly after 10 p.m. Tuesday at Texas Health Harris Methodist Hospital Fort Worth. Tuesday was Emilee’s birthday, the medical examiner’s website stated.

Deputies responded to a shooting call shortly after 8 p.m. Tuesday in the 1200 block of West Farm Market 917 near Joshua.

Paramedics found that the girl had been shot and she was taken to the Fort Worth hospital where she later died.

Her 19-year-old stepbrother had been in the house clearing the chamber of the rifle when it went off, said Lt. Tim Jones of the Johnson County Sheriff’s Office on Wednesday.

“The two were inside the house,” Jones said. “I don’t believe anyone else was inside.”

The brother had two “dummy” rounds in the rifle that had been placed above a loaded round, authorities said. He ejected the two dummy rounds, but forgot about the loaded round.

“He believed he was making the weapon safe by pulling the trigger to drop the bolt on an empty chamber,” Jones said in a news release. “However, the chamber wasn’t empty and discharged.”
