23-year-old convicted of capital murder in robbery-slaying

FORT WORTH -- A 23-year-old Fort Worth man was convicted of capital murder Thursday in the death of a 25-year-old during a home invasion robbery in 2011.

Marquise Brooks was automatically sentenced to life in prison without possibility of parole. Prosecutors did not seek the death penalty.

Kevan Dunlop, 25, was found dead in a bedroom closet of an apartment in the 7400 block of Ederville Road in Fort Worth on Jan. 6, 2011.

He and three friends he had known since middle school had been playing a video game when four men burst in, according to prosecutors. At least two intruders started shooting.

Dunlop had graduated from Tuskegee University and was preparing to go to law school at Texas Southern University in Houston, prosecutors said. He ran to the bedroom to try to escape but was shot once while running and twice in the back as he lay wounded in the closet, prosecutors said.

His friends Darius Hill and Michael Anthony McIntosh Dorsey, both 24, were seriously wounded. Another friend, Willie Woodard, broke a leg after jumping from a second-story window.

Brooks' co-defendant Floyd Dewayne Myles, 21, pleaded guilty to a murder charge and is serving a 35-year sentence in exchange for his testimony against the others. James Jones and Nathaniel Redic are awaiting trial, according to Tarrant County district clerk's records. Jones is charged with murder and Redic with capital murder.

Brooks' attorney, Warren St. John, told the jury that Brooks did not know that the men he was with planned to commit a robbery or that someone would be killed.

Robert Huseman, who prosecuted the case with Kevin Rousseau, argued that Brooks was guilty under the law of parties even if he didn't fire a weapon. The law of parties holds conspirators equally culpable in a crime. Huseman asked the jury to convict Brooks, saying some people cannot be rehabilitated.
