Teen gets probation in Arlington graffiti case

FORT WORTH -- A teen pleaded guilty Wednesday to painting racial and homosexual slurs on cars and homes in an Arlington neighborhood in June, but a trial was set for another young man charged in the case, according to Tarrant County criminal court records.

John Austin Cartwright, 18, of Arlington was sentenced to three years' deferred-adjudication probation as part of a plea agreement. If he complies with the terms of his probation, he will not have a conviction on his record.

He pleaded guilty to a charge of graffiti causing $1,500 to $20,000 damage, a state jail felony. He entered his plea Wednesday morning in Criminal District Court No. 371.

Another defendant, Daniel Sibley, 19, of Fort Worth, is scheduled to go to trial March 18 in the same Fort Worth courtroom.

Sibley would be the only one of five young people to have a trial in the case.

Seth Hatcher, 19, and Morgen Rae Aubuchon, 18, both of Arlington, also received three years' deferred-adjudication probation last month as part of a plea agreement.

A juvenile who was 16 at the time also faces court action.

Hatcher and Aubuchon each have to pay $300 in fines and more than $6,400 in restitution and perform 120 hours of community service at a minimum of 20 hours a month at the Samaritan House, the AIDS Outreach Center or any other organization approved by the court.

The two must also testify truthfully about the actions of their co-defendants in any trial that might arise from the June 10 incident, which angered Arlington residents whose vehicles and homes were defaced.

The five were arrested after surveillance cameras at some of the homes captured clear images of people painting the graffiti, prosecutors have said.

The incidents occurred close together, and some suspects admitted their roles when approached by police.
